CAR ACCIDENT ... lady wants 1 Mill for cut finger (California)?

Hi ... there was a car accident in my family where an 80 year old lady hit our car that was crossing a street ...





- relatively low speed at impact


- everyone had seat belts on


- everyone was insured


- no air bag deployment





the old lady got taggedd in her driver door, thus popping her driver door glass ... thus the cut finger.





the car has been repaired ... no problem ( $5,000)





her finger healed long ago. PROBLEM IS SHE IS STILL COMPLAINING ABOUT SOFT TISSUE PAIN / DISCOMFORT in the neck and back nearly a year later ...





SHE WAS BACK HOME AFTER THE ACCIDENT WITHIN AN HOUR THE DAY IT HAPPENED .. and moving about as normal ...





her lawyer is trying to ask for one million $$$$$$$$$$$$ over this. Yes ... 1 Mil !!!!!!!





CALIFORNIA is where it happened ....





WHAT WILL SHE REALLY GET????????? How will this really turn out???

Generally the lawyers will settle out of court for your maximum coverage.




I hate to say this, but she very well may get $1 million for it. Was the acident your family's fault, or hers? Then if she has neck pain, she can say it is a result of the accident and will recieve compensation for punative damages because your family caused the accident. Sorry :(




not $1 mill, but maybe like 50,000, still hurt. no judge in their right mind will give her that much $$ 4 a finger




ok several questions.


$5k for repairs; is that her auto or yours?


did you report to your insurance company?


how did you know about the 1 million? did you receive a letter from the lawyer asking for that much? and if so, appears that they want you to let your insurance company know; they do this to get your attention.


what are you policy limits?


if you have minimum coverage, which i believe could be 5K in CA, (not sure if that is property damage or bodily injury) you are in a world of hurt.





sure she got a cut finger from the glass in the door. also her neck and back maybe a problem since she is 80 years old, and not resilient vs someone younger say age 30.





also; how do you know so much about her? the fact she was home and moving about as normal? are you stalking her?





your insurance company will investigate and make a determination of what her injuries are worth. just because a lawyer demands 1 million means nothing. he is just trying to get your or your insurance company attention. lawyers always ask for the impossible but never get.





5k for repairs is not minor, this would be a decent hit.





you better hope that you have decent coverage on your policy. if you dont have enough to cover her injuries, they will go after your family for the balance owed.


ie; assets; home equity, savings, garnishments etc.





it is doubtful anyone will give you a specific number of what her claim is worth, since we dont have all the facts, her medical records, copy of the damages to your car and hers. only your insurance company can decide the true value of her claim.
